These Terms of Service ("Terms") govern your use of the ThetaIQ website (thetaiq.net) and web application (thetaiq.kimi.pro) — together, the "Service" — operated by Jay Stovall, doing business as ThetaIQ ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
ThetaIQ is a software workspace for self-directed options traders: trade journaling, wheel and spread tracking, screeners, analytics, community features, and optional read-only broker connections. We provide tools and information — nothing more.
ThetaIQ is not a broker-dealer, investment adviser, or fiduciary, and nothing on the Service is investment, legal, tax, or financial advice. All content — including analytics, AI-generated commentary, screeners, community posts, and other members' displayed performance — is for informational and educational purposes only. It is not a recommendation or solicitation to buy or sell any security or to adopt any strategy.
Options involve substantial risk and are not suitable for every investor. Before trading options, read the OCC's Characteristics and Risks of Standardized Options. You alone are responsible for your trading decisions and their outcomes. Past performance — yours or any member's — does not guarantee future results.
Paid plans (Pro, Elite) are billed by Stripe. Subscriptions renew automatically until cancelled. You can cancel, switch plans, or update payment details at any time from Settings → Subscription & billing; cancellation takes effect at the end of the current paid period and fees already paid are not refunded except where required by law. We may change prices with advance notice; the change applies to your next renewal. Taxes may apply.
You may optionally connect a brokerage account through SnapTrade, a third-party integration service. The connection is read-only: ThetaIQ cannot place, modify, or cancel trades. Your brokerage credentials are entered only with SnapTrade — ThetaIQ never sees or stores them. Access tokens are stored encrypted and used solely to display and sync your positions into the Service. You can disconnect at any time from Settings → Broker sync, from your SnapTrade account, or at your brokerage. Your use of SnapTrade is also subject to SnapTrade's own terms and privacy policy.
You own the trade data you log and the content you post. You grant us a limited license to store, process, and display it as needed to operate the Service — including showing your stats and profile to other members when you opt in to community features. You're responsible for what you post: don't post unlawful, misleading, or manipulative content, and don't present hypothetical or cherry-picked results as typical. We may remove content that violates these Terms.
The Service, its design, branding, and software are ours. Your data and posts are yours. Market data and third-party content remain the property of their respective owners.
The Service is provided "as is" and "as available" without warranties of any kind. Market data, broker data, and analytics may be delayed, incomplete, or wrong; calculations depend on the data you and your broker provide. We don't warrant accuracy, availability, or fitness for a particular purpose.
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages — including trading losses — arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $100 if you paid nothing.
You can delete your account at any time from Settings. We may suspend or terminate accounts that violate these Terms or abuse the Service. On termination, your right to use the Service ends; provisions that by nature survive (disclaimers, liability limits, ownership) survive.
We may update these Terms from time to time. We'll post the new version here and update the date above; material changes will be flagged in the app. Continued use after the effective date means you accept the updated Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Texas, and the parties consent to their jurisdiction.
